Terms of Service

1. Acceptance and service provider

These Terms govern your use of the Azhar Wasal / Azhar Tawseel (أزهر وصل) app, website, grocery ordering, delivery, and related services provided by Mahal Saleh (محل صالح). By using the Service or placing an order, you agree to these Terms and the policies linked in the app.

2. Eligibility, guest access, and accounts

You must have legal capacity to place an order. Guest checkout may be available. Certain features—including account completion, email verification, wallet use, cross-device history, or sensitive actions—may require phone verification. You are responsible for accurate information, control of your device, and keeping OTP codes private. Notify support promptly if you suspect unauthorized use.

3. Product information, availability, and pricing

• Images and descriptions are illustrative. Packaging, size, origin, color, or appearance may differ.
• Prices, promotions, stock, delivery fees, taxes, limits, and minimum order amounts may change before an order is accepted.
• Weighted or variable-price products may be charged according to the actual supplied weight or amount shown in the final bill.
• If an item is unavailable, we may propose a substitute, reduce quantity, remove the item, or request your decision. Material changes requiring approval will not be treated as accepted until you approve them.

4. Order submission and acceptance

Submitting an order is a request to purchase. An order may be declined or cancelled because of stock, pricing errors, delivery coverage, safety, suspected misuse, payment failure, or operational limits. The final confirmed order and bill may reflect approved substitutions, actual quantities, or other permitted adjustments.

5. Payments

Available methods may include cash or card on delivery, bank transfer, wallet points, and Tabby. You must provide valid payment and verification information. Bank-transfer orders may remain on hold until receipt is confirmed. If you choose Tabby, eligibility, approval, instalments, collection, fees, and disputes relating to Tabby financing are governed by your agreement with Tabby. We do not guarantee approval by a third-party payment provider.

6. Delivery

You must provide an accurate, accessible delivery address, map location, and working phone number, and be available to receive the order. Delivery estimates are not guarantees and may be affected by traffic, weather, demand, access, safety, or events beyond reasonable control. Delivery may be refused or rescheduled where the location is outside coverage, unsafe, inaccessible, or materially different from the supplied location.

7. Cancellations, missing items, and refunds

Cancellation availability depends on the order stage. Prepared, dispatched, perishable, or delivered items may not be cancellable except where required by law or our Refund Policy. Report missing, damaged, incorrect, or materially defective items promptly with reasonable evidence. Approved refunds are returned using an available method and may take additional processing time. 8. Wallet points and promotions

Points, discounts, free-delivery rewards, and promotions have no cash value unless expressly stated. They may have eligibility rules, limits, and expiry dates, and may be corrected or withdrawn in cases of error, refund, cancellation, fraud, or misuse.

9. Communications

You agree to receive communications necessary to verify your account and fulfill or secure an order, including OTP, status, driver, payment, and support messages. Optional promotional communications remain subject to your choices and applicable law.

10. Acceptable use

You must not submit fraudulent orders or payment proof; impersonate another person; misuse OTP, wallet, promotion, review, or refund systems; harass drivers or staff; interfere with the Service; introduce malicious code; scrape or reverse engineer protected parts of the Service; or use the Service unlawfully. We may limit, suspend, or terminate access and preserve relevant records where reasonably necessary to protect users, staff, the Service, or legal rights.

11. Intellectual property

The Service, branding, software, layout, and original content belong to us or our licensors. These Terms provide a limited, revocable, non-transferable right to use the Service for personal ordering only.

12. Third-party services

Maps, messaging, payment, Tabby, and other third-party services may have separate terms and privacy policies. We are not responsible for their independent decisions, outages, or acts beyond our reasonable control, except where applicable law provides otherwise.

13. Disclaimers and limitation

We aim to keep information and the Service accurate and available, but availability, delivery estimates, catalog details, and uninterrupted operation are not guaranteed. To the maximum extent permitted by applicable law, liability is limited to direct, proven loss arising from the affected order. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded, including mandatory consumer rights.

14. Changes, governing law, and contact

We may update these Terms for legal, security, operational, or Service changes. The current version and date will be published here. These Terms are governed by the applicable laws of the Kingdom of Saudi Arabia, and disputes are subject to the competent Saudi authorities and courts unless mandatory law provides otherwise.
